Update to Policy Changes to Enhance Transportation
Safety of Hazardous Materials Effective January 1, 2008

On April 9, 2007, BNSF announced that it will provide discounted rates to shippers who transport TIH/PIH commodities in improved tank carsintroduce rate incentives based on car risk factors for transportation of TIH/PIH commodities.

Effective January 1, 2008, tariff discountsincentives for TIH/PIH commodities will be based on the most improved and enhanced tank car identified by the Association of American Railroads (AAR) as the DOT specification tank car 112J500W for anhydrous ammonia and 105J600W for chlorine, or any new DOT specification tank car that meets or exceeds meeting this performance standard.

The following discounts to off of the published tariff will apply beginning January 1, 2008:

Normalized Steel, jacket, full head shield $1,050

Non-normalized steel and/or no jacket and/or no full head shield and/or pre-1989 build $0

Retroactive Discount Credits
Responding to the concerns that our customers have expressed about the availability of the improved tank cars after the January 1, 2008, effective date, Rretroactive discount credits will be offered for any new DOT specification tank car 112J500W (anhydrous ammonia) and 105J600W (chlorine), or for any new DOT specification tank car meeting their performance standard, which are placed into service on BNSF during the period January 1, 2008 – December 31, 2009.

Procedures on how you can apply for the retroactive discount credits will be made available by August 1, 2007.

We are confident that this change serves to align our mutual interest to develop and use an improved tank car while providing time for the industry to take delivery and begin to utilize the new equipment. We are committed to hope this change will encourage our TIH/PIH shippers to use the most improved and strongest cars available as soon as possible to help BNSF ensure the safety of our employees, customers and the communities in which we operate.
