Despacho Previo Rule Change

The current despacho previo rules allow for 48 hours of free time to complete all the documentation required for the legal exportation from the US and for importation of a shipment into Mexico. Effective October 1, 2008, BNSF will allow 24 hours free time to complete all documentation for export to Mexico. All other terms/rules will remain unchanged.

Except as otherwise provided, shipments of grain or grain products moving in shuttle service from the United States to Mexico via any Texas-Mexico border crossing points are subject to the following provisions:

A. Calculations of Charges:

  1. Twenty four (24) hours free time will be allowed for the completion of all documentation required for the legal exportation from the United States and for importation of a shipment into Mexico.
  2. Free time will be computed from the first 12:01 a.m. after the shuttle train is released loaded.
  3. Following the expiration of free time, a Document Delay charge will be assessed until the entire train is released for entry into Mexico. The document delay charge will be $5,000 per train, per day, or fraction thereof.

B. Exception:

No charges will be assessed if the free time has expired but at the time the train is released for entry into Mexico the train has not yet arrived the following locations.

  1. Rincon, NM for a train enroute the El Paso gateway.
  2. Spofford, TX, for a train enroute the Eagle Pass gateway.
  3. Temple, TX, for a train enroute the Brownsville gateway.
  4. Temple, TX, for a train enroute the Laredo gateway. (A)
