Jeff Moreland Named Executive Vice President, Public Affairs; Roger Nober Joins BNSF as Executive Vice President, Law & Secretary

FORT WORTH, Texas, December 7, 2006:

Burlington Northern Santa Fe Corporation (BNSF) (NYSE: BNI) Chairman, President and Chief Executive Officer Matt Rose today announced the appointment of Jeff Moreland to executive vice president, Public Affairs, with responsibility for Federal and State Government Relations, Corporate Communications, and economic regulatory policy. Rose also announced that Roger Nober will be joining BNSF and will take over Moreland’s Law and Secretary responsibilities. Both changes are effective January 1, 2007. Moreland and Nober will report to Rose.

Reporting to Nober are: Jim Gallegos, vice president and Corporate General Counsel, and Paul Hoferer, vice president and General Counsel. Rick Weicher, vice president and General Counsel – Regulatory, will also report to both Moreland and Nober.

Nober is a partner in the Washington, D.C., office of Steptoe & Johnson LLP, where he is focused primarily on transportation law and legislative matters. Prior to joining Steptoe, Nober was appointed by President Bush as Chairman of the Surface Transportation Board (STB), a position he held from November 26, 2002, until Dec. 31, 2005. Prior to joining the STB, Nober was the Counselor to the Deputy Secretary of Transportation. From 1997 to 2001, he served as Chief Counsel for the Committee on Transportation and Infrastructure of the U.S. House of Representatives, where he was the lead staff member on TEA-21, the Interstate Commerce Commission Termination Act and other transportation-related infrastructure and regulatory matters.  Nober earned his J.D degree from Harvard Law School in 1989 and his B.A. degree from Haverford College in 1986.

In commenting on the announcements, Rose said that “Jeff has led our Law Department since 1995 and has played a critical leadership role both at BNSF and within the industry. In his new position, Jeff will continue to guide the company’s public policy efforts as well as participate in various industry initiatives.”

Rose pointed out that “The Board and I are extremely pleased to have Roger Nober join our Executive Team. He brings a wealth of experience and knowledge in law, legislative, regulatory and policy-making related to the transportation sector covering all modes and including many of the most important transportation issues of the past decade.”
