Appeals Court Rules BNSF Deprived of a Fair Trial in Anoka, MN Case

Fort Worth, Texas, September 14, 2010:

We are pleased that the prior verdict has been reversed and BNSF has been granted a new trial. As the opinion stated, "BNSF was deprived of a fair trial." While we have deep sympathy for the families of the individuals involved in this tragic event, we believe that an objective and properly instructed jury will find that the great weight of evidence demonstrates that BNSF acted properly and that unfortunately, the vehicle went around the gates and warning devices at this grade crossing. BNSF believes in the judicial process and looks forward to a fair and impartial new trial.
